How to claim water damage from your insurer with an independent expert report

Water damage is the most frequent — and most disputed — loss. An independent expert report establishes the origin and stops the insurer shifting responsibility.

Water damage is the most common loss in home and building insurance, and also the one that generates the most disputes. The reason is almost always the same: the insurer disputes the origin of the damage, because who pays and what the policy covers depend on it.

The origin determines the cover

A leak from a communal roof, a broken downpipe, structural condensation or rising damp are not the same thing. Each origin has a responsible party and a different fit within the policy. An appraisal that does not correctly identify the origin usually results in a partial indemnity or a refusal of cover.

What an independent expert report establishes

An independent technical report locates the origin of the water with non-destructive methodology —infrared thermography, depth hygrometers, watertightness tests— without relying on the insurer's version. From there it quantifies the damage and delimits liability. That document is the basis for negotiating a fair indemnity or, if the offer remains insufficient, for triggering the contradictory appraisal under article 38 LCS.

Repair is a later stage

Two stages should not be confused. The expert report establishes the origin, extent and liability —the evidence stage. The repair of the damage (waterproofing, treatment) is a separate stage carried out by a specialist contractor. Damp treatment in Barcelona has specific solutions that fall outside the scope of the expert report.

Frequently asked questions

Does home insurance cover leaks?
It depends on the origin and the policy terms. An accidental leak is usually covered; rising damp or a pre-existing construction defect often is not. The expert report is what distinguishes one case from the other.

Who is liable if the leak comes from the communal roof?
If the origin is in a common element, liability falls on the homeowners' association and its insurance, not on the affected owner.

And if the insurer offers less than the repair costs?
You can reject the offer and request the contradictory appraisal (art. 38 LCS), providing your own report.
