Disputes in homeowner associations affect common elements: façades, roofs, communal installations, structure. The report determines the origin of the damage, liability (developer, contractor, community or individual owner) and quantification of the repair.

Before commissioning a report
01 Who pays for the expert assessment in a community?
It depends on the case. It can be commissioned by the community, an affected owner or their lawyer. The cost may be recovered from the liable party if the claim succeeds.
02 Can it be used to claim against the developer?
Yes. Within the LOE deadlines (art. 17), the report documents defects attributable to the developer or contractor.
